By accessing or using Bestaty ("the Service"), operated by Bestaty ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These terms apply to all users of the platform, including agency owners, agents, and administrators.

Bestaty is an AI-powered real estate platform that provides:

• Automated WhatsApp AI agent for lead qualification and client communication
• Customer Relationship Management (CRM) dashboard
• Property inventory management
• Analytics and business intelligence
• Calendar and scheduling tools
• Broadcast messaging capabilities

To use Bestaty, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities under your account.

You must be at least 18 years old and have the legal authority to bind your organization to these terms. Each agency account must be associated with a legitimate real estate business.

You agree to use Bestaty only for lawful purposes. You must not:

• Send spam, unsolicited messages, or use the platform for harassment
• Violate WhatsApp's Terms of Service or Business Policy
• Use the AI agent to deceive leads about the nature of automated communication where disclosure is required
• Upload false property listings or misleading information
• Attempt to reverse-engineer, decompile, or hack the platform
• Use the platform for any illegal activity, including housing discrimination
• Share your account credentials with unauthorized parties
• Exceed your plan's usage limits through automated or abusive means

The Bestaty AI agent is an automated assistant designed to help with lead qualification and communication. While we strive for accuracy:

• AI responses may occasionally be inaccurate or inappropriate
• You are responsible for reviewing and monitoring AI conversations
• The AI does not provide legal, financial, or professional advice
• You should configure the AI's personality and responses to align with your business practices
• Critical decisions (pricing, contracts, legal matters) should always involve human review

You acknowledge that AI technology has limitations and agree that Bestaty is not liable for any damages resulting from AI-generated responses.

Bestaty offers multiple subscription plans. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis
• Plans auto-renew unless cancelled before the renewal date
• Prices may change with 30 days' notice
• Downgrading may result in loss of access to certain features
• Usage overages may result in temporary service restrictions or additional charges

We offer a 30-day money-back guarantee on all paid plans. If you are unsatisfied with Bestaty within the first 30 days of your subscription, contact us for a full refund. Refund requests after 30 days are handled on a case-by-case basis.

You retain ownership of all data you upload or generate through Bestaty, including:

• Property listings and descriptions
• Lead and client information
• Conversation history
• Business analytics and reports

You grant Bestaty a limited license to process this data solely to provide and improve our services. We do not use your data to train AI models without your explicit consent.

The Bestaty platform, including its design, code, AI models, branding, and documentation, is the intellectual property of Bestaty and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works of our platform.

By using Bestaty's WhatsApp integration, you agree to comply with:

• WhatsApp Business Terms of Service
• WhatsApp Business Policy
• WhatsApp Commerce Policy
• All applicable messaging regulations in your jurisdiction

Bestaty is not responsible for WhatsApp account restrictions or bans resulting from your use of the platform. You are responsible for ensuring your messaging practices comply with WhatsApp's policies.

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by:

• Third-party service outages (WhatsApp, cloud providers, AI providers)
• Force majeure events
• Your internet connectivity or device issues
• Scheduled maintenance windows

To the maximum extent permitted by law, Bestaty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay subscription fees. You may cancel your account at any time through the dashboard settings.

Upon termination, we will retain your data for 30 days to allow for export. After that period, data will be permanently deleted.

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of Bestaty after changes constitutes acceptance.
